These Terms of Service (“Terms”) govern your use of somata.health, the Somata waitlist, feedback forms, optional deposits, emails, and related website features operated by Spring Lab, LLC (“Somata,” “we,” “us,” or “our”).
By using the website, joining the waitlist, submitting feedback, or making an optional deposit, you agree to these Terms. If you do not agree, do not use the website.
Somata's Current Stage
Somata is an early-stage website, waitlist, feedback, and product development project. We are building a personal health intelligence system intended to help users organize and understand their health information over time.
Somata does not currently offer user accounts, health record storage, medical record uploads, AI health analysis, subscriptions, or clinical services. Product descriptions on the website refer to planned or intended features unless specifically stated as currently available. Features, pricing, availability, launch timing, and product direction may change.
Joining the waitlist without making an optional deposit does not guarantee access, early access, a specific feature, a specific price, a discount, or a launch date. Deposit benefits are governed by the terms stated at checkout, in a receipt, or in a written offer.
Not Medical Advice
Somata does not provide medical advice, diagnosis, treatment, emergency response, or clinical care through the website, waitlist, feedback forms, emails, or other current materials.
Any information provided by Somata is for general informational and educational purposes only and is not a substitute for advice from a physician or qualified healthcare professional.
Do not disregard professional medical advice or delay seeking care because of anything you read on Somata's website or receive from Somata. If you are experiencing a medical emergency, call 911 or your local emergency number immediately.
Your use of Somata does not create a doctor-patient, clinician-patient, therapist-patient, or other healthcare professional relationship.
Eligibility
You must be at least 18 years old to use the website, join the waitlist, submit feedback, or make an optional deposit. Somata is currently intended for users in the United States.
Optional Deposit
Somata may offer an optional $1 deposit for early supporters.
Unless otherwise stated at checkout, deposits are one-time payments, not recurring subscriptions. A deposit is not an investment, does not purchase equity or ownership in Somata or Spring Lab, LLC, and does not guarantee that Somata will launch by a specific date or include any specific feature.
The current $1 deposit offer reserves a 25% lifetime discount on Somata's future paid subscription if and when a paid subscription becomes available. “Lifetime discount” means the discount applies for as long as Somata offers the applicable paid subscription and the discount remains associated with the signup email used for the deposit. More specific terms shown at checkout, in a receipt, or in a written offer control for that deposit.
Unless otherwise stated at checkout, deposits are refundable upon request before Somata launches a paid product or applies the deposit benefit. Payment processing is handled by third-party providers such as Stripe. We do not directly store your full payment card number.
User Submissions and Feedback
You are responsible for anything you submit to Somata, including waitlist responses, feedback, messages, ideas, and other content.
You agree not to submit unlawful, misleading, abusive, spammy, infringing, privacy-violating, or otherwise harmful content. You should not submit another person's private information unless you have the legal right to do so.
The current website, waitlist, and feedback forms are not designed to collect medical records, lab results, diagnoses, treatment details, genetic data, insurance information, Social Security numbers, or other highly sensitive information. Please avoid including that information in free-text feedback responses.
You retain ownership of information you submit. By submitting information to Somata, you allow us to use, store, process, and review it as reasonably necessary to operate the website and waitlist, communicate with you, process deposits, improve Somata, protect the service, and develop the business.
If you submit product ideas, suggestions, or feedback, we may use them without restriction, attribution, or compensation.
Acceptable Use
You agree not to misuse the website, interfere with its operation, attempt unauthorized access, submit malware or spam, impersonate others, scrape or harvest data improperly, violate another person's rights, or use Somata for unlawful, harmful, fraudulent, or abusive purposes.
We may restrict or remove access to the website, waitlist, deposit offer, or future early-access program if we believe you violated these Terms or created risk for Somata or others.
Intellectual Property
Somata's name, logo, website, designs, text, graphics, software, and other materials are owned by Somata, Spring Lab, LLC, or their licensors. You may not copy, modify, distribute, sell, or create derivative works from Somata materials except as allowed by law or with our written permission.
Third-Party Services
Somata may use or link to third-party services, including form providers, payment processors, analytics tools, email providers, hosting providers, database providers, and advertising platforms. We are not responsible for third-party services, websites, terms, privacy policies, security, or practices.
Privacy
Your use of Somata is also governed by our Privacy Policy, which explains how we collect, use, and share information.
Changes to Somata
Somata is early-stage. We may change, suspend, discontinue, rename, redesign, limit, or remove any part of the website, waitlist, deposit offer, early-access program, or future product at any time.
Disclaimers
Somata is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of availability, accuracy, reliability, security, merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the website will always be available, secure, accurate, complete, or error-free, or that Somata will launch or include any particular feature.
Limitation of Liability
To the maximum extent permitted by law, Somata, Spring Lab, LLC, and their owners, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, personal injury, medical decisions, or other damages related to your use of Somata.
To the maximum extent permitted by law, our total liability for any claim related to Somata will not exceed the greater of the amount you paid to Somata in the six months before the claim arose or $100.
Indemnification
You agree to defend, indemnify, and hold harmless Somata, Spring Lab, LLC, and their owners, employees, contractors, agents, affiliates, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your use of Somata, your violation of these Terms, your submitted content, or your violation of another person's rights.
Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any disputes not resolved informally will be brought in the state or federal courts located in Utah, unless applicable law requires otherwise.
Changes to These Terms
We may update these Terms from time to time. If we make changes, we will post the updated version and update the “Last Updated” date. Updated Terms apply after they are posted.
